Residency Requirements

To be eligible to file for a divorce in Alabama, the couple must meet the residency requirements of the state. Otherwise, the Alabama court will not have jurisdiction over the case.

The law states that in case of marriage dissolution, one of the spouses must have been a bona fide resident of Alabama for at least six months before the Petition is filed with the court.

The Petition must be filed with a court in the county where at least one of the spouses currently lives.
